Richard and Josie Zeldenrust, the appellants, bought and sold property through Oliver Martin and his real estate brokerage firm, Elliott Bay Investment Company (Elliott Bay). In the course of their business dealings with Martin, the Zeldenrusts executed one promissory note to Elliott Bay and three to Martin for deferred commissions owed him (the Zeldenrust notes).
