The issues in this appeal and cross appeal arise out of a promissory note and mortgage deed executed by the plaintiffs, Joseph and Antoinette Voll, in favor of the defendant-third party plaintiff, Lafayette Bank and Trust Company (bank), acting as trustee of the retirement account of the third party defendant, Alex Klein.
