McHUGH, Chief Justice:

In this case, Karl S. Dietz appeals from the ruling of the Circuit Court of Cabell County, which denied him habeas corpus relief. The appellant is presently incarcerated in the state penitentiary at Moundsville. The habeas corpus relief was sought in the circuit court following this Court's affirmance of the appellant's first degree murder conviction. See State v. Dietz, 182 W.Va. 544,
