This appeal came before a panel of judges pursuant to a motion to modify Commissioner Kenneth H. Kato's ruling. RAP 17.7. We deny the motion to modify. However, because the case appears to have precedential value, we adopt the Commissioner's ruling, as modified, as our opinion.
