Defendant-appellant, Stephen R. Lampman, was involved in a one-vehicle accident with his pickup truck in which his passenger was killed. Appellant was transported to the hospital for emergency treatment. At the hospital, appellant was questioned by Patrolman Kerro regarding the accident and was asked to submit to a blood-alcohol test.
