Defendant was charged with criminal possession of a weapon in the third degree based on police evidence that he had been seen throwing a 9 mm automatic weapon into the trunk of his car, from which it was immediately recovered by the police. At trial, the defense presented two witnesses who testified that they had witnessed the arrest and, in contradiction to the police account, stated that the police had first put several men up against the car and then had themselves opened...
