On the evening of December 6, 1990, appellant, Vincent Johnson, was a passenger on a COTA bus driven by Donald Fouts. Appellant was the last passenger on board when the bus reached Georgesville Road. Fouts apparently told appellant to put out a cigarette, which appellant did. When appellant approached the front of the bus on his way out, he punched Fouts in the face, Fouts wrestled appellant off the bus...
