In this case we focus on Maryland Code (1977, 1987 Repl.Vol.), §§ 13-209 and 13-210 of the Transportation Article which establish an Assurance Fund ("Fund") within the Motor Vehicle Administration ("MVA") to compensate "any interested person [who] has sustained [a] loss or damage" due to "an omission or error in the filing, recording, or indexing of a security interest ... made by an employee of [MVA] in the course of employment."
