Previously this court reversed defendant's conviction for manslaughter in the second degree pursuant to Penal Law § 125.15 (1) (171 A.D.2d 900). Under our rationale, Penal Law § 125.15 (3), which requires that defendant's conduct be intentional, was held to be the exclusive subdivision under which defendant could be prosecuted for manslaughter in the second degree when the victim committed suicide...
