Contractor appeals partial summary judgment. We affirm.

FACTS

Mooney's, Inc. (Mooney's) is a Minnesota based contractor. Mooney's received notices soliciting bids on three asphalt resurfacing projects from the South Dakota Department of Transportation (DOT).
