BRAZIL, J.:

Brian J. Higgins appeals the district court's order granting the City of Lenexa's (City) motion to dismiss due to Higgins' failure to file a notice of appeal. K.S.A. 22-3609(2). Higgins contends the time in which to file an appeal had not run and the City's policies deny a defendant equal protection. We affirm.
