On 6 March 1990, Jimmy Ray Nobles was charged with refusing to allow an inspection of a licensed fish dealership, "West End Seafood," in Greenville, North Carolina, pursuant to N.C.Gen.Stat. § 113-136(k). When defendant refused to allow two officers to inspect fish being sold on the premises, the officers subsequently obtained a search warrant and issued a misdemeanor citation to defendant for the refusal.
