Thomas Koonce (defendant) was tried before a jury in the Superior Court on an indictment charging him with murder in the first degree. He asserted self-defense and, at the close of the evidence, moved for a required finding of not guilty on the ground that the prosecution's evidence was insufficient to warrant a finding beyond a reasonable doubt that he had not acted in self-defense.
