The defendant was serving sentences in the Norfolk County house of correction when, on August 21, 1990, six days after he had been sentenced, the sheriff released him from custody in the implementation of orders that a Federal District Court judge had issued to alleviate unconstitutional overcrowding at the house of correction.1 See Libby v.
