The respondent, Rodney Houf, after presenting an alibi defense at a jury trial, was convicted of unlawful delivery of a controlled substance. The trial judge imposed an exceptional sentence based solely on the judge's personal belief that Houf had lied during his testimony. The Court of Appeals reversed the exceptional sentence, holding that this circumstance did not constitute a sufficient basis for an exceptional sentence under the Sentencing Reform Act...
