The issue presented here on the pleadings is whether a deceit action will lie where the plaintiffs, who allegedly were fraudulently induced to contract to purchase realty, closed on their transactions after discovery of the fraud. The defendant dresses its argument in the garb of reliance, contending that consummation of the contract with full knowledge of the facts precludes, as a matter of law, reliance on any misrepresentation.
