The issue is whether the admission into evidence of the uncounselled, post-indictment statement of defendant, Ivan Sanchez, violated his constitutional right to counsel. In an unreported opinion, the Appellate Division ruled that defendant's statement was admissible, and affirmed his conviction for non-capital murder (N.J.S.A. 2C:11-3a(1) and -3a(2)) and possession of a weapon for an unlawful purpose (
