Roy K. Gill was a passenger in a vehicle which was rear-ended by an insured driver of California State Automobile Association (CSAA). Mr. Gill demanded $37,156 from CSAA to settle his claim for the neck and back injuries suffered in the accident. CSAA offered $35,000. Mr. Gill accepted.
