Plaintiff, Nahel Haji, appeals as of right from a September 26, 1989, order of summary disposition entered by the Wayne Circuit Court in favor of defendants. Although the order recites that it was based on reopening defendants' motion for summary disposition under MCR 2.116(C)(10), the record shows that the court raised the issues sua sponte on grounds not raised either in the pleadings or in defendants' previously denied motion for summary disposition...
