The State appeals from an order of dismissal for violation of the speedy trial rule. The issue presented is whether the speedy trial period is recommenced when defense counsel files and serves on the prosecutor a notice of appearance following a defendant's failure to appear for trial and his subsequent arrest on a bench warrant.
