Defendant Donald Teague was convicted of attempting to possess marijuana with intent to distribute, 21 U.S.C. §§ 841(a)(1) and 846, and carrying a firearm during a drug trafficking crime, 18 U.S.C. § 924(c). He appealed the district court's denial of his motion for a new trial, arguing that he was denied his constitutional right to testify because his counsel did not call him as a witness at his trial.
