Brian Sands pled guilty to second degree burglary, I.C. §§ 18-1401, 1402, and 1404, and received a fixed sentence of two years followed by an indeterminate term of three years. Sands timely appealed his judgment of conviction and sentence and also filed an I.C.R. 35 motion for reduction of sentence.
