Plaintiff filed this action against his former employer and his Pension Benefit Committee claiming that defendants misrepresented the tax benefits of an early retirement program. In his complaint, plaintiff asserts a claim for violation of fiduciary duties under ERISA and five separate state law claims for breach of contract, breach of fiduciary duties, fraud, negligent misrepresentation and a statutory wage claim.
