This matter is before the Court on defendant's motion to dismiss and plaintiffs' motion for a stay of these proceedings. Plaintiffs' two count complaint alleges that defendant violated the Commodity Exchange Act, 7 U.S.C. §§ 1-26, specifically, 7 U.S.C. §§ 6(a), 6b & 6o, and committed common law fraud and misrepresentation.
