Frank Phillip Zubizareta was charged with felony driving under the influence (D.U.I.). I.C. §§ 18-8004, -8005(3). He moved to dismiss the case and to suppress evidence on the grounds that the arresting officers had no reason to approach him when he was sitting in his legally parked car, and that his arrest violated his fourth amendment rights to be free from unreasonable searches and seizures...
