ORDER

NORTON, District Judge.

This matter is before the court on defendant Westvaco Corporation's motion for summary judgment.

I. BACKGROUND

Westvaco Corporation (hereinafter "Westvaco") manufactures and distributes paper and chemicals. The majority of Westvaco's products are transported by rail with approximately 29% to 30% by trucks.1 Westvaco, as part of its present business, does not perform trucking.
