This case was removed to this court from the Court of Common Pleas of Erie County, Pennsylvania on January 30, 1990. The cause of action arose out of a motorcycle accident which took place on July 16, 1988 along Route 20 in Ripley, New York. Plaintiff Lawrence Eimers alleges that the sidestand on his 1983 Honda CB550SC Night Hawk motorcycle failed to retract upon contact with the road as he was leaning his motorcycle...
