WEISBERGER, Justice.

Raymond Laperche was convicted of assault with intent to commit sexual assault in the Superior Court on October 23, 1990, after trial by jury in the Superior Court. Thereafter he filed a motion for new trial, which was granted. The defendant appeals from the denial of a motion to dismiss on due process grounds and also from a denial of a motion to dismiss on double jeopardy grounds. We affirm.
