In an earlier proceeding before this court, American Cyanamid Co. ("American") sought a stay of class certification, class notice, and class proceedings pending appeal. Stephens responded by moving to dismiss American's appeal. This court refused to issue the stay, and on August 10, American filed the record of proceedings.
