The appellant, John Lionel Neal, Jr., was convicted of capital murder, in violation of § 13A-5-40(a)(4), Code of Alabama 1975, as charged in the indictment. He was sentenced to death.

On February 16, 1987, Mrs. Wilmer Underwood was found dead in the kitchen of her Foley, Alabama house. An autopsy revealed that Mrs. Underwood had been beaten to death. Mrs. Underwood's house had been ransacked and her...
