This is an action brought by Plaintiffs under the Comprehensive Environmental Response, Compensation and Liability Act of 1980 ("CERCLA"), 42 U.S.C. §§ 9601 et seq. At issue is the responsibility for clean-up of the Cortese Landfill ("the site") in the Town of Tusten, New York. Gaess Environmental Services Corporation ("Gaess"), which was subsequently acquired by Defendant SCA Services...
