NIEMEYER, Circuit Judge:

The Black Lung Benefits Act of 1969, as amended, provides for the payment of benefits to qualifying miners and their dependents. See 30 U.S.C. § 922 (1988). As defined in the Act and its implementing regulations, the term "dependent" includes a divorced spouse who receives at least one-half of his or her support from the miner.
