WILLIAMS v. HOWARD

No. 90-1382.

598 So.2d 1300 (1992)

Robert D. WILLIAMS and Lois Williams, Plaintiffs-Appellees, v. Frederick HOWARD and William Nearing and Prudential Property & Casualty Ins. Co., Defendants-Appellants.

Court of Appeal of Louisiana, Third Circuit.

May 12, 1992.

Attorney(s) appearing for the Case

Stafford, Stewart, Andrew Texada, Alexandria, for defendants-appellants.

Morrow, Morrow, Patrick Morrow, Opelousas, for plaintiffs-appellees.

Before GUIDRY, STOKER and CULPEPPER, JJ.

STOKER, Judge.

This case presents two issues: whether the judgment in this case is a final, appealable judgment and, if so, whether the trial judge erred in holding that there is uninsured motorist coverage for plaintiff's injuries under his automobile policy with Prudential.

We hold there is not a final, appealable judgment and remand for a trial on the merits. The issue of uninsured motorist coverage will not be considered in this appeal.
