BENJAMIN v. STATE

No. 90-01431.

593 So.2d 1236 (1992)

Darrell BENJAMIN, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

March 4, 1992.

Attorney(s) appearing for the Case

James Marion Moorman, Public Defender, and Wendy E. Friedberg, Asst. Public Defender, Bartow, for appellant.

Darrell Benjamin, pro se.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Wendy Buffington, Asst. Atty. Gen., Tampa, for appellee.

PER CURIAM.

The public defender has filed an Anders brief in this case. However, Darrell Benjamin, pro se, raises two points in this appeal. As to his first point on appeal, the supplemental record filed with this court shows that, contrary to appellant's assertion, the jury was instructed on the lesser offense of petit theft. We also reject appellant's contention that there was insufficient evidence of burglary.

Affirmed.
