While an inmate at the Utah State Prison, appellant Robert Gregory Burlett (Burlett) filed a writ of habeas corpus with the Third Judicial District Court. Burlett's petition asserted that a restitution order issued by prison officials following a disciplinary hearing constituted cruel and unusual punishment and violated his right to due process.
