Plaintiff has filed for relief under Title VII, 42 U.S.C. §§ 2000e—2000e-17, and under 42 U.S.C. § 1983, for violation of rights guaranteed by the United States Constitution. The plaintiff has also filed pendent state claims under 29 L.P.R.A. § 146. Defendants have moved to dismiss under Fed. R.Civ.P. 12(b)(6) for failure to state a claim upon which relief can be granted.
