The plaintiffs, James and Barbara Harvel, filed a complaint in the circuit court of Williamson County against the defendants, the City of Johnston City (City) and Lawrence A. Lipe & Associates (Lipe), to recover damages sustained when James Harvel was injured at the construction site where he was working. The complaint alleged that James' injuries were the proximate result of the defendants' willful failure...
