OPINION

GARFF, Judge:

The State of Utah, Office of Recovery Services (ORS), appeals the trial court's denial of its petition to modify. We reverse and remand.

The parties do not dispute the facts. On April 16, 1984, the mother gave birth to the child. Since the child's birth, the mother has received public assistance for the child. On May 14, 1984, defendant signed an affidavit acknowledging paternity and duty of support.1
