The defendant Brown was charged with separate counts of kidnapping [§ 565.110.1(5), RSMo 1986] and robbery in the second degree [§ 569.030.1, RSMo 1986]. The jury convicted Brown of kidnapping and acquitted him of robbery in the second degree. Brown was sentenced to ten years imprisonment in accordance with the jury conviction for kidnapping.
