VANCE, Justice.

This is an appeal from a summary judgment. We will affirm the judgment.

The summary judgment record reflects that on the evening of June 15, 1988, Terry Nishimuta, an eighteen-year-old Fort Hood soldier, purchased a quart of beer at a Diamond Shamrock station in Waco. The store clerk did not require any identification from the underaged Nishimuta. Several hours later, while Nishimuta was returning to Fort Hood, his vehicle struck...
