This is an appeal from a summary judgment granted in favor of the City of Fort Worth, Texas. The suit arose out of a contract for sewage treatment services between Fort Worth and the City of Arlington, Texas. Arlington sued Fort Worth for a declaratory judgment that Fort Worth is obligated to provide sewage treatment services beyond February 14, 2001, the date upon which the contract expires.
