Randolph S. Jackson sued MBank Houston, N.A. (MBank) in Texas state court for breach of contract and promissory estoppel in connection with MBank's refusal to lend money to Jackson despite its allegedly having promised to do so. Before Jackson's case came to trial, MBank was declared insolvent and the FDIC was appointed as receiver.
