This controversy arose from the rescission of a contract for the sale of a motel. Defendants Orrs, the purchasers, were awarded a judgment and plaintiff seller appealed.

This appeal was originally assigned to the Court of Appeals, which dismissed it for being untimely filed. A petition for review was granted by the Supreme Court, and the matter was rebriefed and reargued. We now vacate the Court of Appeals opinion dismissing plaintiff...
