HILL, Justice.

William Randolph Heitman appealed from his conviction by the court upon his plea of nolo contendere to the charge of possession of methamphetamine with intent to deliver. His punishment was assessed at five years in the Texas Department of Corrections, now the Texas Department of Criminal Justice, Institutional Division, probated for five years.
