BACKGROUND

Plaintiff, Dan Rindal, instituted the above-entitled action seeking monetary damages for the defendants' purported breach of contract. Plaintiff's complaint also asserts claims for breach of the covenant of good faith and fair dealing, constructive fraud, fraud and conversion, as well as a claim under the Racketeer Influenced and Corrupt Organizations Act ("RICO"), 18 U.S.C. § 1961
