The defendant, Benjamin Adolpho Orozco, was originally charged with possession of cocaine, in violation of LSA-R.S. 40:967(C). He pled guilty to attempted possession of cocaine and was sentenced to serve two years at hard labor. The defendant appealed his sentence as being excessive.
