ORDER

BOBRICK, United States Magistrate Judge.

This matter is before the court on plaintiff's motion for a new trial and the court's own initiative to consider a new trial. We find that the jury verdict as to damages (in the amount of $60,000) awarded plaintiff to be against the clear weight of the evidence resulting in substantial injustice, and as such a new trial will be granted on that issue.
