DEITS, Judge.

The state appeals from an order sustaining defendant's demurrer to three counts of being a felon in possession of a firearm. ORS 166.270. We reverse and remand.

In August, 1983, defendant pled guilty to second degree burglary. The trial court suspended the imposition of sentence and ordered probation for 18 months, which defendant successfully completed in March, 1985. In November, 1990, defendant was indicted on three counts of being a felon...
