JUNELL, Justice.

Appellant was convicted by a jury of carrying a deadly weapon in a penal institution. The jury assessed punishment, enhanced by two prior convictions, at imprisonment for life. The conviction was reversed and appellant was ordered acquitted by a majority of this court on November 15, 1990. The Texas Court of Criminal Appeals granted the State's petition for discretionary review...
