SEERDEN, Justice.

This is a summary judgment case. Appellant, Stonewall Surplus Lines Insurance Company, was the excess insurer for several insureds in a wrongful death suit. Appellees, Jaime A. Drabek and the law firm of Hirsch, Glover, Robinson, & Sheiness (collectively "Hirsch, Glover"), were hired by the primary insurance carrier to defend the suit.
